2016 ACA “A” Penalty
Affects: Employers who fail to offer coverage to at least 95% of their benefit eligible employees for any given month. When: Any employee receives coverage and is eligible for a subsidy from the exchange, a penalty is assessed for all eligible employees, regardless of their offered or enrolled status.
2016 ACA “B” Penalty
Affects: Employers who offer coverage that isn’t considered “Affordable” or “Minimum Value.” When: Any employee receives coverage and is eligible for a subsidy from the exchange, a penalty is assessed for each employee who receives a subsidy (or the amount of the “A” penalty is assessed, whichever is less)
